James Barbar

James has been working at Bannermans Lawyers since July 2022. James has amassed a wealth of experience over the years, making him a go-to resource for construction related legal issues and litigation in NSW. James has been instrumental in handling complex legal matters within the construction industry, providing valuable counsel to clients across various projects and disputes with an ability to navigate the intricacies of construction law and find effective solutions tailored to client specific needs.

Since joining Bannermans Lawyers, James has handled a comprehensive array of construction and strata matters. He possesses significant experience in representing clients before the NSW Civil & Administrative Tribunal and the Supreme Court of NSW for various home building applications, and typically undertakes the following kinds of work:

Building and Construction

  • Providing legal representation for owners corporations of varying sizes, from 3 to over 350 lots, in building defect claims against builders and developers.
  • Providing guidance to owners corporations on building defects, insurance claims, legal remedies, and applicable limitation periods;
  • Regularly appearing for owners corporations in building defect claims before the NSW Civil & Administrative Tribunal and the Supreme Court of NSW for directions hearings, interlocutory applications, and final hearings.
  • Advising owners corporations, builders, and developers on the Design & Building Practitioners Act 2020 (NSW);
  • Representing homeowners in building defect litigation;
  • Providing support to clients in building contract negotiations;
  • Assisting owners corporations in obtaining freezing orders against developers.

Strata Litigation

  • Appearing for owners corporations in applications for interim orders in the NSW Civil & Administrative Tribunal;
  • Representing owners corporations and lot owners in disputes over increased insurance premiums, unreasonable by-law refusals, and claims to invalidate resolutions of owners corporations.

Qualifications/Memberships

  • Bachelor of Law (University of Technology, Sydney) 2020;
  • Bachelor of Business (Finance) (University of Technology, Sydney) 2020;
  • Graduate Certificate in Professional Legal Practice (University of Technology, Sydney) 2020;
  • Admitted as a Lawyer of the Supreme Court of NSW;
  • Member of the Law Society of NSW.
