Before joining Bannermans Lawyers as Special Counsel in 2012, Duncan worked for over 25 years in some of the leading building, construction and insurance practices in Western Australia, London and Sydney. Duncan became a partner in 2018.
Since settling in Sydney 20 years ago Duncan has worked as a senior solicitor and partner at some of the leading national law firms in the construction and Insurance practices specialising in Home Owners Warranty and professional indemnity matters as well as general construction claims. Most recently Duncan also worked as a Senior Claims Examiner in a large International insurer.
Duncan practices mainly in the New South Wales Supreme Courts, the District Court, and the New South Wales Civil and Administrative Tribunal (formerly CTTT). He is a well known and respected practitioner with substantial expertise in all aspects of:
- Advising insurers on policy coverage and claims liability
- Litigated and unlitigated claims for and against all construction professionals including architects ,engineers, quantity surveyors and certifiers
- Home owners warranty and building defects claims
- All aspects of claims for and against strata companies including claims relating to defects, building encroachment and disputes over boundaries.
- Providing policy advice and acting in insurance indemnity disputes in relation to Home warranty and professional indemnity, contract works, Strata insurance and insurance policies
- All forms of alternative dispute resolution, including mediation and expert determination and references;
- Providing advice and acting for clients in claims pursuant to the Building and Construction Industry Security for Payment Legislation
- Providing advice to Strata Companies, Insurers owners and building professionals in all aspects of building and Builder’s warranty Claims
