Bannermans Lawyers has a strong commitment to providing excellent service to all of our clients, persons and organisations with whom we deal, including respecting your concerns about privacy. We understand that you may have questions about how we collect and use information, whether through our website or in the course of our commercial relationship with you. We will not collect personal information (information about an individual, from which the individual's identity is apparent or can reasonably be ascertained) about you unless:

  • necessary for one or more of our functions or activities; and
  • collected by lawful and fair means and not in an unreasonably intrusive way.

We will not collect sensitive information (as defined in Section 6 of the Act) about you, without your consent, unless required by law.

Generally, we will only collect personal information about you solely from you. However, there will be instance where it is not reasonable or practical to obtain such information solely form you, if we are to properly advise you in relation to the issues which you have sought our advice or to properly conduct any legal matters which you have engaged us, in which case we may need to obtain personal information about you from third parties. Such information may include reports from consultants and searches from organisations retaining relevant records, such as the Australian Security and Investments Commission, the Department of Land and Property Information and strata managers.

  • You may gain access to the information which we collect, to the extent permitted by law, by contacting us at the address specified above. We will take reasonable steps to correct any personal information which is not accurate, complete and up to date.
  • We collect such information for the purpose of properly advising you in relation to the issues which you have sought our advice and/or properly conducting any legal matters which you have engaged us or for the purpose of complying with our statutory obligations.
  • Generally, we will disclose your personal information to third parties only with your consent or as required by law. However, there may be instances where it is appropriate and reasonable to disclose such information to third parties for the proper conduct of matters in respect of which you have engaged us, e.g. in the course of legal proceedings in respect of which you have retained us.
  • We may also collect information for the purpose of complying with statutory obligations, such as under the Legal Profession Act 2004 and Income tax, GST and other taxation legislation.
  • The main consequences of failing to provide information which we may seek to collect from you are that we may be unable to properly advise you or conduct the matters which you have engaged us and may be unable to continue acting for you, for that reasons or for the reason that we will be unable to comply with our statutory obligations.

Use and Disclosure of Personal Information

Bannermans will not use or disclose personal information for a purpose ("Secondary Purpose") other than for the primary purpose for which it was collected ('Primary Purpose"), unless:

  • The Secondary Purpose is related to the Primary Purpose (or directly related in the case of sensitive informaton) and you would reasonably expect us to use or disclose the information for the Secondary Purpose; or
  • You have consent to disclose; or
  • The information is not sensitive information and is used for the Secondary Purpose of direct marketing and:
    • you have consented to receive direct marketing communications or it is not practical to obtain that consent prior to such use;
    • you have not requested to receive direct marketing communications, noting that we do not charge for effecting such a request; and
    • each such direct marketing communication contains our address, telephone number and email address, which you may use to request not to receive further direct marketing communications; or
  • As otherwise required or permitted by law.

Maintenance of Information

We will take reasonable steps to:

  • ensure that all personal information which we collect is accurate, complete and up to date;
  • protect the personal information we hold from misuse and loss and from unauthorised access, modification or disclosure; and
  • destroy or permanently re-identify personal information if it is no longer needed for any purpose for which the information may be used or disclosed under the NPP.

We have set out in this policy our practices with respect to management of personal information. We must make the document available to anyone who asks for it.

Our website does not collect personally identifiable information from your computer when you browse our website and request pages from our servers. This means that, unless you voluntarily and knowingly provide us with personally identifiable information, we will not know your name, your email address or any other personally identifiable information. When you request a page from our website, our servers log the information provided in the HTTP request header including the IP number, the time of the request, the URL of your request and other information that is provided in the HTTP header. We collect the HTTP request header information in order to make our website function correctly and provide you the functionality that you see on this website, as our servers use this information to deliver to you the pages on this website. We also use this information to better understand how visitors use our website and how we can better tune our website, its contents and functionality to meet your needs.

Our website uses "cookie" technology. "Cookies" are encrypted strings of text that a website stores on a user's computer. In addition, the service providers we use to serve and host our web content and/or deliver our emails, use session and persistent cookies, to track the number of times this website is accessed and whether the site was accessed from an advertisement or another linked site. Sometimes cookie technology used to track the number of times a page is viewed. Bannermans is only responsible for our website. We are not responsible for the privacy practices or the use of cookies on websites that you have accessed our website from and for the consequences of linking to other websites that you may access from our website.

Changes to Policy

To the extent permitted by law, we may update or change our privacy policy, but all changes will be recorded in the updated policy, so that you will always know what information we gather, how we might use that information and whether we will disclose it to anyone.
