CCTV FAQ – What happens if you have a dispute involving someone claiming an invasion of their privacy because a camera is facing into their lot?

Hopefully, such an areas will in most cases be pre-empted by proper owners corporation approval mechanisms.

If such a scenario does arise, the owners corporation should consider the following course of action:

  • Consideration of whether the installation of the equipment exceeds any approval which may have been given.
  • Consideration of whether the use of the equipment constitutes a nuisance or other interference with use and enjoyment of lot or common property. This will require a degree of investigation, e.g. enquiries as to the extent to which the camera has a view of the interior of lot property.
  • Attempts to mediate a negotiated solution between those involved in the dispute.
  • If that is not productive, taking legal advice and initiation and pursuit of appropriate Tribunal proceedings.
