CCTV FAQ – What role do cameras play in enforcing by-laws, particularly around parking or short-term letting?

Cameras can play an important role in day-to-day monitoring of the compliance of by-laws. The recorded footage can be used as evidence to prove a breach of by-law, particularly, for parking, where issues often arise when lot owners do not park their cars in their designated parking spaces, or they wrongfully occupy the visitors parking spaces. The recorded footage can also serve as evidence of whether the lot owner has breached the conditions in by-laws for short-term letting.

Consideration should be given to how cameras will be used to perform this function. For example, it is not sufficient to demonstrate that a by-law has been breached, it being also necessary to demonstrate who has breached the by-law. As a practical matter, this necessitates consideration, prior to installation of cameras of issues such as:

  • What function as the camera intended to perform?
  • In what position and with what view angles would cameras be installed to best perform that function?
  • At what times should such cameras be active and how should they be monitored?
  • What supplementary evidence will be required in order to found action in response to breach of by-laws?
