CCTV FAQ – For how long do the recordings need to be kept?

A recent Tribunal case, Benoit De Tarle v The Owners Corporation Strata Plan 576 [2022] NSWCATAP 77, suggests that:

  • CCTV recordings are records of the owners corporation;
  • but are not records of a type which the owners corporation is required to retain under Section 180 of the Strata Schemes Management Act 2015 or otherwise.

Consequently:

  • they need not be retained for the seven year period for which other records may need to be retained.
  • they may be recorded and stored using equipment which overwrites them on a periodic basis or even discarded.

That said, the owners corporation has its own interests in relation to such footage, turning on the purpose for which it was made and consideration should be given, at the point of decision about installation of cameras, to the following issues:

  • What footage will be recorded?
  • How will it be stored?
  • How long will it be retained?
  • What access will be provided?
