CCTV FAQ – What can you do if the owner does not install the camera with due authority?

If a lot owner installs a camera involving alteration of common property without approval of the owners corporation, this will constitute unauthorised work in breach of Section 111 of the Strata Schemes Management Act 2015 and the owners corporation can take action to remedy the situation:

  • At first instance, the owners corporation will generally give notice to the relevant owner requiring the owner to cease using the camera, remove the camera and reinstate the relevant common property area.
  • If that is not appropriate or not successful, the owners corporation may apply to the Tribunal for appropriate orders, including an order reinstatement of the relevant common property area at the owners cost. There have been at least two instances in recent years where an owners corporation has been successful in such an application, e.g. Stojiljkovic v Whittle [2021] NSWCATCD 97
  • If the owner does not comply with the Tribunal order, it may be possible for the owners corporation to undertake the relevant work at the owner’s expense.
